Mutual divorce

What is the legal action taken by the court . if one party doesn't come for. hearing for 3 times consecutively.

The court may pass an ex-parte divorce final decree. Grounds for challenging the decree would rest on what circumstances the appellant justifies his absence from date of hearing

In divorce by mutual consent if one party not appearing for continuous 3 times, the Family Court will dismiss the petition. No ex-parte decree of divorce passed by Family Court for petition of divorce by mutual consent as suggested wrongly here. Decree of divorce is passed only if both parties appear for final hearing of divorce petition in MCD and give consent to finalisation of the case.
