Procedure in Supreme Court

There is a regular bail petition for a vigilance case which was rejected by High Court of Jharkhand. How much time will it take to file and get a hearing date in Supreme Court? Also what is the procedure of doing so?

Dear Querist,

 

As regards procedures, you will have 90 days from date of passing of order of rejection of regular bail petition passed by High Court of Jharkhand for moving the Hon'ble Supreme Court. But since, its bail matter, it is expected that you may expedite the filing of appropriate petition in that regard.

 

After you file the same in the Supreme Court, after necessary scrutiny by the Registry of the Petition, subject to here also you having expedited the curing of defects, if any, immediately it would be ready for listing. If due some reasons, even after curing defects, the case is not listed, you may mention before the Registrar for an early listing of the Petition, and if you are successful, alright, if not, you may thereafter, mention before the appropriate SC Bench by filing mentioning propforma. If you could convince the Hon'ble Bench, there would an order of urgent listing.
