I am owning an office of 100 sq. ft. in Fort area which was broken open in Jan 02 by committee members of society inspite of I being a founder member as they wanted me to surrender the room to them. An FIR was registered after delay of 2 yrs. due to corruption in police dept. and the case is still pending in Ballard Pier Court of MM.
As a counter blast society made me a party in a civil suit of 1998 claiming that my room is illegally built. It had filed a suit against other room owners as their rooms were illegally built and sold by the builder. This case is now settled and while society has and other room owners have agreed to and filed consent terms case against me was dismissed by judge saying that the ground no longer exists.
I have suffered heavy fiancial losses, mental torture due to this mallacious act on part of society and want to flie a recovery suit for Rs.15Lacks.
Can some learned person advice if I can do so and what will be the court fee ?
