Regarding payment

When mou was done it had been mentioned about refundable and non refundable payments by the company. They gave only a small amount. Its been 3 years and the agreement is not made and according to mou its been lapsed. Now should we have to return the amount given by them to cancel the mou and give the property to others

the property was given in jdu. The builder had given a small amount to the property Owner when mou was signed but its been three years agreement has not been made. In mou time limit was given 90 days. Now to give the property to others as the time is lapsed do we have to return the money given by the builder.
