U/s 138 time-frame of notice and case reg.

What are the timescales & deadlines that need to be taken care of u/s 138 case.

  1. Presentation of Cheque in The Bank.
  2. Time within which the Notices needs to be send.
  3. Time within which a case can be registered u/s 138.

Q. Is there a time limit for the case to be filed after the notices are sent within correct timeframe.?

Q. In State of Maharashtra Stamp Duty of 2% is required. Is it possible to just file the case without paying stamp duty, with a request to pay at later stage. (so that it can be filed within timeframe).

Cheque should be presented within 3 months of it's date

Send a demand notice within 30 days of the chaque returned by the bank.

Give a period of 15 days to pay the amount.

Failing to which file a suit within 30 days of the end of notice period.
