In case of partition what is the procedure for summoning .Pls tell me deatails about it ,because at this earlier now i am pursuing LL.M (final).
pls sir guide me to handle a case of partition and what is the procedure for this
i had a business conducting agreement with a person for my hotel for a period of 3 yrs that expired on 30th june 2008.however on 25th he filed a suit against me to get a permanent injuction on us, but the court refused his ad interim relief and asked him to follow the agreement and peacefully vacate on 30th june 2008.now he is using muscle power and still conducting business without any agreement.the police telling me to get the order modified and include an order stating the police to help. now i would like to know what should i do and how to go about it?
The Supreme Court of India has given in its website the format for a writ petition for mandamus under article 226 of the constitution of India. Is the same format to be used for a writ petition to be made to the Bombay High Court ?
What is the relative advantage of making the writ petition to the High Court as compared to making it to the Supreme Court ?
Can we appeal to the Supreme Court on the High Courts decision on our writ petition ?

sir my father purchased a piece of land(withbuilding) with out knowing that it is a litigistic land and the case regarding the owner ship of the property is pending before the court actually the case summary is ... the plaintiff who wants to trouble the defendant put a case in the court claiming that he is the owner of the property but in actual we very well know that the property surely belongs to our seller(defendant).now the case has come up to the stage of an issue what is the meaning of the term "issue" further out the 3 conditions put by the plaintiff
1.to restrain the defendant from interfering in the plaintiff peaceful possession
2.to confer ownership title on the plaintiff
3.to reimburse the amount
clause 1 has been verdicted against the plaintiff does it mean the case is closer to an end

i have filed a suit for partition .But a coprcerner who had a more share as he got .That is why to get my equal share from such person i have filed a suit for partition . And now he wanted to sold his share ,so pls suggest me what type of action i could taken against him ,so that i could prevent him to do so. And he is also taken more share as he actual obatianed.
