Ref: my post on 7/11 regarding notification
to police station about security agency

two queries.pl.suggest.
1)one man committee for looking after security of the said car parking to be registered or not? if registered then which
way?
2)for monthly contribution by the residents
money receipts to be given or not?

Article 19 says the following:
Protection of certain rights regarding freedom of speech, etc.—(1) All citizens shall have the right— (b) to assemble peaceably and without arms;
Is the Constitution acknowledging that citizens will normally be in possession of arms but only while making a peaceable assembly, will have do it without arms? Otherwise the question of asking the citizens to disarm while making a peaceable assembly does not arise.

Dear experts,
1)If a citizen of India feels that one or more of his constitutionally guaranteed fundamental rights are being violated by State, should he approach High Court first under Article 226 or should approach Supreme Court first under Article 32?
2)If a citizen feels that one of his fundamentals rights though not mentioned under part III comes under part III can he approach High Court or Supreme court to seek a clarification or opinion of court? If yes, will it be filed as a writ? What kind of writ will it be? Example: If citizen feels the right to property is also covered under Article 21 and wants opinion of the court.

In my previous query, I am forget to add that Writ Petition under Article 32 of the constitution is maintainable before the SC(Not H.C)if the S.L.P is pending?
As Special Leave Petition is against the order of the Impugned order passed by the H.C and the Writ Petition is for the enforcement of fundamental rights which the Respondents/O.P is blocking by using delaying tactics
If in the S.L.P the interim relief has been pleaded whether there is need to file the Writ Petition separately for main prayer?

I Need ur ideas & CITATIONSin the below case...
1, Husband & Wife are living seperately due to family problems. Child of 1-1/2years old was with the mother.
2,Husband filled a petition for RESTITUTION OF CONGUAL RIGHTS IN FAMILY court.
3,Mother went to Singapore for ONE WEAK to attend an INTERVIEW .
4,At that time husband came to his house with 12 unknown persons and kidnapped the child.
5, Police registered a case against her husband and others under Section 363 & 506(1)
6, MOTHER files a suit of Habeas corpus in High court to see her child & also for an order of custody.
7,Husband after getting Anticipataory bail files a petition of G.W.O.P asking to anounce him as the Guardian of the child in court.
8, Case is pending before high court
We are infovour of the MOTHER. Pls give CITATIONS and other usefull points to get the child from her HUSBAND.

Sir, this is Rent control act matter of landlord-tenant dispute.
Trial court rejects release application of landlord on bonafide need as well as on hardship.
Appellate court also reject release application on bonafide need that there are two ancestral houses of landlord in other district, BUT interfere in comparative HARDSHIP that no hardship of tenant in case of eviction.
High Court set-aside both courts judgments and order to evict, said it is immaterial that two houses of landlord in other district, court can not dictate to landlord to whether he live.
In Landlord-tenant dispute "whether the High Court was Justified in interfering with the conclusion arrived by the both the courts below on question of finding of Facts (concurrent finding) which is based on Affidavits? That the landlord need being not bonafide and genuine?" and set aside lower courts order & allowed landlord petition.
SC passed interim stay on eviction in SLP filed by tenant.
What is the future of this judgment in SLP?

My first passport was issued in 1990.At that time Passport application form had a specific space for writing alias name, which my father filled up as "SANTU"- my nick name as my parents and close relatives call me.
My given name is UTPAL and surname SAHA. All my official documents are in teh name of " UTPAL SAHA".
When the passport was re-issued in 2000 after 10 yrs of validity, Passport application form probably had no space for filling-up Alias. When the passport was delivered, I didn't notice that they have hand-written my given name as " UTPAL @ SANTU". Since this passport was valid upto 2010 and I had no opportunity to visit abroad in this period, I never gave it a close look.
Now it has expired and I hv to apply for re-issue and in on-line application I filled-up Given name as UTPAL and RPO Kolkata rejected my form.
I don't wish to carry forward the alias as there are no official documents avaialable with me which bears this alias name. However I have all documents registered with my name as UTPA SAHA.
Pls advise what best can be done in this situation.
