Dear Sir/Mam,
I got my wife enrolled for pursuing Diploma in Java course in NIIT, I paid a sum of 36,500 through my credit card, while I was making the payment the executive informed me that the classes would begin in a week's time, therefore we waited to hear back from the institute, however NIIT did not care to respond back at all, we followed up with the institute for more than 3 months, after that we went to the institute to request for refund the money, there's a clause mentioned in the enrollment document that "refund of tutition fees are possible in full if the student wishes to withdraw from a course/program registered, at least 2 days prior to the scheduled start date of the program/course". I have been following up with the centre head for the refund for more than 45 days now.. however i am not getting any proper response. When i call the institute no body answers my call or don't even respond to my messages. I need expert advise on how should i got about recovering the money from the institute.

Ravinder
If 'X' had written his property to 1st son children A,B of 1 acre in North side & 2nd son children 'C' of 1 acre in south side through registered WILL.After X has died & where probate is not compulsary then 'A' & 'B' made oral partition of 0.5 & 0.5 acre by entering terms of comprimize conditions of oral partition with clear boundaries of the properties & both A,B signed before lokadalat and decree is passed by lok adalat. Now my question is
1) Once lokadalat decree is passed & after 5 years whether 'C' had any right to suit against lokadalat decree for A,B regarding dispute in boundary
2)Any Outsider (Not'C') who had interested in that property can suit in civil court at any time by challenging ownership of on A,B
3) whether Lokadalat decree can be challenged by 3rd party ,if so what is the time limit for that 3rd party

Dear Sir / Madam,
A very good evening to you.
Kindly be informed that my younger brother passed away in a road accident on July 12, 2010 at around 16:10 PM, leaving behind his wife & his daughter, who's now 4 years & 3 month old. The vehicle that hit my brother's motorcycle is untracable till now as there are no witnesses to this accident and Delhi Police, Vasant Kunj have declared that he was hit by unidentified "army" vehicle and they must have also closed the file by now.
Thereafter, his widow wife stayed with us till Oct./Nov. 2010 till she got the claims of all his insurance policies and then moved to her parents home with my brother's daughter. She came to us after that 3 - 4 times and took all her belongings in bits & pieces, which we don't know what all and the keys to her almirahs are still with her. We are sure that she have also taken their original Marriage Certificate issued by Arya Samaj Mandir, Mandir Marg, New Delhi.
Even all pending dues of monthly Kitties & pending EMIs of my late brother's motorcycle were paid by my father as she simply refused to accept the responsibility of same stating that she wasn't aware about the same. It was me who fought hard with my brother's employers to get the cheque made of his full & final pending dues in favor of her.
She didn't even attended my brother's death anniversary prayers/rituals, but, her father did came for 15 mins for the same with my late brother's daughter as we wanted the "money" to be distributed to "sadhus" by brother's daughter's hand.
Now we have come to know that she have got married again on October 2, 2011 without she or her parents bringing the same to our knowledge and is living with her husband at Allahabad and my bother's daughter is living with her maternal uncle (Mama) at Allahabad itself.
Even we would't have objected her to get married again, had she or her parents taken our advise or should have informed us before this 2nd marriage as we have a heart and know that it's very tough & is almost a sacrifice to live such a long life without a companion.
We justifiably feel that in such a situation my bother's daughter's future is more secured with us and hence, we request your good self to kindly suggest us as to how we can obtain custody of my brother's daughter legally. We understand that now legally it's grand parents (my late brother's parent's) right first to obtain custody of my late brother's daughter. We were not like them, but, now we also want to know if my parents have any right on the money that she have obtained from my brother's insurance policies, for which kindly advise.
Also like to inform you that my late brother & this lady got married without my & her parent's permission in May 2006 at Arya Samaj Mandir, Mandir Marg, New Delhi. My parents accepted their marriage after two weeks of their marriage and both of them started living with us as husband & wife thereafter, but, her parents accepted their marriage only after my brother's daughter's birth in August 2007.
Taking all facts mentioned above into consideration kindly help, assist & guide.
Many thanks & earnest regards
