Car parking in builder's colony

My name is GR Gupta. I have purchased a 3 BHK flat in a builder's colony in Gurgaon in March, 2011. In addition to the cost of the flat, the builder has taken Rs. 2.5 lakhs as open car parking charges. At the time of
purchase of flat, I was not aware of the
Hon'ble SC ruling about car parking charges by builders. When I asked the builder to refund me the car parking charges, he is refusing to give the money back saying that I have purchased the open car parking knowing fully about the rules.
Please advise me what legal action can be taken against the builder in this case

issue legal notice to builder . move consumer forum for deficency in service and ask for refund with interest
