(Querist) 20 March 2014 This query is : Resolved
Dear sir,
My question is suppose A is a Muslim Male want to do marriage with B Hindu lady.
Lady put up a condition that she will not convert his religious.
Male also put up a one condition that after solemnized marriage as per special marriage act, again nikah must be done as per muslim custom.
In this case marriage is possible? if yes. Kindly elaborate the procedure.
If lady not want to change her name then what?

Thanks,

Looks like hypothetical and academic query.

If the female is reluctant to convert into Muslim religion, the marriage can be solemnized as per the provisions of Special marriage act only and subsequent nikah is not valid by any law because the lade refuses to convert moreover she is already married under special marriage act, therefore as per muslim law, a woman cannot marry a man while she is already married and having a husband, plurality of husbands not allowed for Muslim women unlike Muslim men who can have even three women as wives while going for a Nikah (marriage) with the fourth woman.

marriage under SMA is possible but Nikah is not possible without conversion.

Academic and hypothetical query. A woman can marry either under Muslim Personal Law or Special Marriage Act but not twice.
