Hello Raman,
S.173(8) Cr.P.C. contemplates permission for 'further investigation'.If any court is hearing this plea this can be rebutted only on the basis of evidence collected during earlier evidence showing there is is no need for further investigation and that this will only delay the matter,whereas there is ample evidence already on file.Moreover ordering further investigation will be seriously prejudicial to accused's interests.If some new accused is likely to be included by further investigation, matter will be different.
