Is it mandatory for both the parties to be present in court on the day of decree to be given for contested divorce. Last day judge heard from both parties and both of the party agreed to all terms.
Due to time constraint last day i.e 29.06.2018, judge could not give the decree and given a next date of 26.07.2018.
On this 26.07.2018, is it necessary for both bride and groom party to be present?? Or the judge will give the decree if the lawyers of both parties be present??
After completion of the signing and hearings for Mutual divorce case, waiting for the decree to be received in hand, wife has filed case of mental torture against husband and his family. For this, court has kept the final decree in hold and has not given to both husband and wife.
What is the next thing which can happened now?
Can the court cancelled the decree of Mutual divorce at this point of time?
Within how many days of submission of final papers of MCD and after completion of all hearing, does the divorce process gets completed or court grants the divorce?

Case history:
It is MCD, both agreed mutually.
In divorce agreement it has been specified that child aged 3 years will be staying with mother as she is a state govt. school teacher and has good earning and will meet the father whenever the child want and father and other family members can also meet the child. Father have to bear the educational expense of the child. It has been agreed by both the parents, paper signed and the divorce case is going on in court. Both husband and wife gone to magistrate and 2 hearings has been done. Magistrate asked to think again on the decision of separation as per rules and have asked to meet again after few days. That will be 3rd hearing. Now the wife is saying that she do not want to keep the child with her, the child should stay with the father. But the father do not want to keep the child as he stays out of India almost 15-20 days a month due to professional life.
Query:
1. Is it possible to change the statements of divorce paper at this point of time?
2. Is the wife can stop the divorce process by raising this point inspite of agreeing earlier, after signing the paper and attended 2 hearing before magistrate?
3. Mother being a govt employee and father being a professional who have to stay outside India in different countries all the year around, court will ask to keep the child with whom, Father or Mother? age of the child is 3 years and Father do not want to keep the child also with him due to the reason given above.
Within how many days of divorce, new marriage can be registered?

If after divorce, the child staying with her mother uses the surname of his/her father and the mother also use the surname of her divorced husband, do anyone of them can claim in the property of husband/father anytime? Will be there any responsibility of the father/divorced husband towards

If husband and wife has both their names in an agreement of flat which is yet to be completed, but now husband want to file divorce. The wife is denying to remove her name from the agreement. What can be done?

Maintenance and child custody
Few days before getting the final verdict paper in hand, wife filed a petition in court stating that she want 10k as maintenance and she cannot keep her child custody.
Earlier it was decided that husband will pay 10k for child and 5k to wife for rent. Wife is a govt employee.
How many petitions can be filed by either party at this stage of case?
Being the child is of 7-8 years, who will take the custody of the child? The father is out of the country due to work for about 300 days in an year.
