Wife's right to ask partition

My Client has a problem that

his wife had filed a Special civil suit for partition from her IN LAWS properties.

She is living in house of her Farther In Law.

She had restricted my client to come at home and wrongly filed a petition that my client left her and deserted her.

they have 2 children 16 and 18 years old both are living with her mother. and also filed petition u/s 9 of Hindu Law

Such suit has cause of action if she has filed such suit on her own behalf. File a petition under order 7 rule 11 of cpc.
