HOW TO FILE A CRIMINAL CASE BY A LAYMAN

(Querist) 21 March 2009 This query is : Resolved
In a complaint before the consumer forum, the opposite party submitted false facts on an affidavit. The complainant also filed an affidavit asserting the true facts and prayed the consumer court for taking cognizance. The Consumer forum did not give any decision on false evidence. In an appeal before the state consumer commission, the complainant/appellant also brought out the falsehood submitted by Opposite Party on oath. The State consumer commission did not give any ruling. How to proceed further. What is the format for filing criminal case and under which rule of IPC/Cr PC in this context? plz help!!

sir,
i cannot agree with apurva completely eventhough a district judge or hon"ble chief justice may take action.
but, it is always advisable to file a criminal complaint before the proper and lowest forum , ....ie, judicial first class magistrate court. you can file the complaint u/s 156 (3) crpc tom be forewarded to the police for enquiry.
go through sec.s 197, 467 ipc etc to see which sec applies to the facts of your case

i do agree with my learned friends.

institute the private complaint, by which thereafter, the inquiry will be sought for further proceedings.

Yes, file a complaint before JMFC a private complaint U/S 156(3) for an inquiry by Police and let the report submitted before the court.

According to you both the District Forum and the State Commission have not accepted your contention of "false facts". In such circumstances, in my opinion the chances of initiating criminal proceedings and succeeding is very remote.
