Regarding property distribution between brothers

Guest (Querist) 19 August 2013 This query is : Resolved
my father-in-law died two months ago of cancer unexpectedly. now the problem is there are three brothers and father has not done any will or i and my husband dont know whether will is done or not. smaller brother was close to daddy so he knows some of the property details but he and second brother are not ready to share the details. now my husband and i are living abroad so cant really investigate personally.my husband is the eldest.problem is both brothers are lying about the property telling us there is no property, some shops are there but telling they were sold before he died. smaller brother went in house took all documents and gold ornaments and tells us he has nothing. can some tell us what to do in this case. we also want the share of whatever property but think, brothers dont want to share they want it for own self. how can we make out details of property or suggest a person who can investigate all for us.

all 3 brothers will have equal share in property . engage a detective agency to investigate . if it is a flat in cooperative society society will give you details

A detective agency is better option as suggested. You can have inquiry from relatives and family friends and tactful diplomatic handling may reveal the truth.

If you know the numbers of th property apply for the extract in the concerned department, you will get the details. If it is self acquired property of the deceased and if he has executed any will in favour of anybody then your husband wont get anything, if it is ancestral then everybody i.e., legal heirs of your FIL gets equal share.

I do agree with the experts.
